Terms of sale
Alain Laboile (EI), operating the website shop.laboile.com (hereafter referred to as the "Website"), offers products and services for sale to individual customers. These Terms and Conditions of Sale (TCS) govern all sales made on the Website and define the rights and obligations of Alain Laboile (EI) and its Customers.
By placing an order on the Website, the Customer agrees to these TCS without reservation.
1. Products and Services
1.1. Photographic Prints
The Website offers:
- Signed prints, available in various formats;
- Limited edition prints, numbered and signed.
Specific details (format, paper type, price) are provided on each product page. If a print is not in stock, a production time of 1 week is required before shipping.
1.2. Books
The books available are detailed on the Website. They can be signed by the author.
1.3. Photography Courses
Courses are provided in the form of downloadable PDF files, accessible immediately after payment confirmation.
2. Prices, Payment Terms, and Invoicing
2.1. Prices
Prices displayed on the Website are in euros (€) and include all taxes (TTC). In accordance with Article 293 B of the French General Tax Code, VAT is not applicable. Delivery fees are calculated and displayed during the order validation process.
2.2. Payment
Full payment is required at the time of ordering. Payments are secured and processed through Shopify Payments, which accepts:
- Credit cards,
- Payment methods compatible with Shopify Payments.
2.3. Invoicing
An electronic invoice can be provided upon request.
3. Delivery and Download Terms
3.1. Delivery of Physical Products
Deliveries are handled via Shopify Shipping and are available to France, the European Union, and international destinations. The average delivery time is 1 week from the date of shipment. Delivery fees are specified before order confirmation.
3.2. Downloading Digital Products
PDF course files are accessible via a Dropbox link sent by email upon order confirmation. This link is not temporary but is strictly reserved for personal use.
4. Right of Withdrawal and Returns
4.1. Physical Products
The Customer has a period of 14 days from receipt of the order to exercise their right of withdrawal. However, personalized products (signed or numbered prints, signed books) are not eligible for the right of withdrawal. Return shipping costs are the responsibility of the Customer. Refunds will be issued within 14 days after receipt and inspection of the returned products.
4.2. Digital Products
The right of withdrawal applies as long as the file has not been downloaded. By accessing the content via the provided link, the Customer expressly waives this right.
5. Responsibilities and Warranties
5.1. Legal Warranties
Physical products benefit from the following legal warranties:
- Legal warranty of conformity (Articles L.217-4 and following of the French Consumer Code);
- Warranty against hidden defects (Articles 1641 and following of the French Civil Code).
5.2. Limitation of Liability
Physical Products: Alain Laboile (EI) cannot be held responsible for improper use of the products by the Customer.
Digital Products: Alain Laboile (EI) is not liable for any technical incompatibility between the downloaded PDF file and the Customer's devices.
Website: Access to the Website is not guaranteed in the event of outages or interruptions beyond the control of Alain Laboile (EI).
6. Disputes and Applicable Law
6.1. Amicable Dispute Resolution
In the event of a dispute, the Customer is encouraged to contact Alain Laboile (EI) to seek an amicable solution. Failing that, the Customer may refer the matter to a consumer mediator or the European Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr.
6.2. Applicable Law
These TCS are governed by French law. In the event of an unresolved dispute, the competent courts will be those of the Customer's place of residence or, failing that, those of the place of business of Alain Laboile (EI).
